Legal Question in Wills and Trusts in Illinois
Hello- my children and I have lived with my father in his home for the last 11 years. My father just passed and in his will it says I should move out within 90 days of his death. Two of my sisters are the executors and they want to abide by this. I want to fight this and stay til the house is sold. Also I was not given the will until 2 weeks after his death so did not know about the 90 days. can they kick me out of the house after the 90 days or can i fight this?

If you don't leave voluntarily, your sisters will have to go to court to evict you. You should consult an attorney in your area to discuss your overall rights and duties. If you were your father's caretaker in the years leading up to his death, you may be entitled to compensation for your services. You should talk to your sister executors to negotiate the terms of your leaving, and the possibility of paying rent to the estate for a period of time. Your sisters probably believe it's going to be easier to sell the house without a tenant.
