Legal Question in Wills and Trusts in Illinois

Hi, my dad passed away a few months ago and his medical bills exceed a couple thousand dollars. Is my mother, his wife, responsible for the medical payments? Because the debt collectors say that this will affect her credit.

Hello,

There is a possibility she is responsible for the medical bills. The details of the circumstances and the extent of your father's estate must be reviewed before providing an accurate answer. Often, a medical facility asks someone to accept responsibility for payent in the event the patient is unable to pay.

Ms. Johnson's answer is correct. We need to know more about the circumstances.

But it should not affect her credit unless and until they sue and obtain a judgment. A lawyer who is knowledgeable of the Federal Fair Debt Collection Act will draft a letter for you which notifies the creditor that it is a disputed claim and what they can or can't do to collect on it.
