That depends. If there is a valid will, the estate will be distributed according to the will. If there is no will, the estate is divided up and distributed to the spouse, the children, and/or possibly other relatives. Every situation is a little bit different. If you've had a death in your family and there was no will, consult an estate/probabe attorney to help you with your particular family situation.
