Legal Question in Wills and Trusts in Illinois
deceased father
My 14 year old daughters father passed away. He was not married and his brother is now in control of his estate. He is not returning my phone calls about life insurance or my request for a copy of the death certificate. Do I have legal recourse- should I obtain counsel to represent my daughter?

Yes. Your daughter is her father's legal heir -- not his brother.

Since your daughter is the heir and beneficiary, of course you should go after the estate and find out what is there.
Should you hire an attorney? That depends on your estimate of the estate. If it is worth nothing and there is no life insurance, it is probably not worth it. If you think there is, or you thing there MIGHT be something there, hire an attorney for the limited purpose of finding the value of the estate and then decide if it is worth pursuing.
