Likely what you need is a legal document called a small estate affidavit. This is a document that allows someone to deal with estates under $100k. The Secretary of State has a specific process regarding transferring cars which if I recall requires an attorney affidavit. I'd like to hear more about the 401k...typically these have someone named as beneficiary and this should sort of take care of itself, in other words the 401k should just go to whomever is named as beneficiary.
