Legal Question in Wills and Trusts in Illinois

Deceased Parents

My parents both died in the last two months. Neither left a will. Can my sisters as their heirs file a Chapter 7 bankruptcy on the debts that are left behind. I received a foreclosure notice on our house on Tuesday, August 21, 2001 and have 30 days to file an answer. If you could please let me know as soon as possible, I would greatly appreciate it. Thank you.

Re: Deceased Parents

I'm not clear what you're asking. Beneficiaries of an estate are not personally liable for the debts. On the other hand, creditors *can* claim payment for their debts and reduce the amounts received. This can't be stopped by bankruptcy (which roughly requires using your existing assets to pay creditors).
