Deed to house

My parents are both deceased leaving behind a home and a will giving it to all 7 siblings. how do we go about changing the title to sell it or do we have to do that at all?

Re: Deed to house

I'm assuming because you are asking about Illinois law, that the house is located in Illinois.

There are many questions that are not answered in your posting, such as: what are the value of the other assets of the estate(s), who is living in the house now, who is administering the estate (the executor), and will there be a probate estate opened?

If the house is the only asset of the estate, it may be possible to sell it without having a probate estate opened, using a bond in lieu of probate. However, you should seek the advice of an attorney before proceeding. This answer should not be considered legal advice since I have not had the chance to review the situation in its entirety. My answer might change given additional facts.

Good luck to you.

Re: Deed to house

You must first file a probate case in the county in which your parents lived. Then an executor's deed may issue after letters of administration and other documents have been issued by the court. Please call for an appointment.
