Legal Question in Wills and Trusts in Illinois

designated money from a will

My late grandfather told me more than once that he was putting aside money for my children for college. My aunt is currently in charge of all the money and has not taken out any of it for this purpose. How can we get this money? Do we need to hire an estate lawyer? My aunt is mentally ill and often becomes unreasonable, plus she lives in another state. Thanks.

Re: designated money from a will

You should hire an attorney asap. The will must be filed with the circuit court, and an estate opened. You can petition the court to have your aunt removed as the executor of the estate.
