Legal Question in Wills and Trusts in Illinois

Am I entitled to a portion of my father's estate?

My father very recently passed away. I am the only child of his first marriage (in southern Illinois), which lasted about 2-3 years. His second marriage lasted 35 years and he had another child by that marriage. He passed away after being married to his third wife for 3 months, with no children by that marriage.

My first contact with my father was when I was 21 years old. My next contact was 19 years later, 9 months prior to his death, by his initiation. I was able to speak to him twice during his last week alive. Unfortunately, that is the extent of our contact during my lifetime.

What are my options concerning his estate? Should I be taking any action against the estate? What should I do? Thanks.

Re: Am I entitled to a portion of my father's estate?

You may not be entitled to anything if he left a valid Will. You should hire an estate attorney and then make sure you have notice of the estate proceedings. Some states have laws protecting a child inadvertently omitted from a Will or when no Will is left. Other states have no such laws. The attorney you hire can research these questions for you.

Do not proceed without competent legal advice and do not assume any entitlement, research it first.
