My Dad died and had a girlfrined he was not maired to. can she calm his estate and I am his only son Will every thing go to me with out a will? How do I find out what he had? What if his home was in his name and his girlfriends?How do I find a lawer?

if you dad died without a will his stuff will go to you. if he owned a house as joint tenants with another, then the house would go to the survivor. you can pull the deed to his house to determine how it was held. if your father died in southern california. contact my office--we can help.

I am sorry for your loss. Assuming he lived in California the general rule is that you would get everything. There are exceptions though. For example, if the house was held in "joint tenancy" it would go to the joint holder (the girlfriend), if he named his girlfriend as beneficiary on an IRA or life insurance then she would get it, and there are some rare cases where a gilfriend may try to make a "Marvin" argument that she is entitled to property absent the above. However, back to the general rule... YOU would normally inherit. One quick thing to check is the deed to his house. Call or email me and we can look that up for you. Good luck!

In Illinois you would inherit everything, not the girlfriend. However, if the house was in joint tenancy with the girlfriend, she owns the house. If you need a lawyer in the Chicago area, please call me. If you need a lawyer anywhere else in the state, call the local bar association.
