estate law and pursuing wrongful death
3 beneficiaries(1 being the executer) decide the estate does not want to pursue a wrongful death action and inform the estate attorney of this decision at 3 different times . However, 1 benefiiciary would like to pursue it Does the estate attorney have the legal right to listen to the 1 beneficiary and continue pursuing the wrongful death action, keeping the estate as a nonimal plaintiff and keeping the estate open and charging the estate fees of continuing with the action?
