Estate question

My father died 2 years ago with no will or instructions. How do I go about becoming the administrator or executor of his estate? I need to settle a few affairs on behalf of the estate including cashing a small insurance distribution made out to ''The Estate of''. He passed away in Cook County, IL.

depends on when your dad died

if he died recently (after 1/1/06) and if the estate is less than 100k and there is no real estate then you can prepare a small estate affidavit and there should be no problem.

otherwise you will need an attorney
