Legal Question in Wills and Trusts in Illinois

An executor of a will is not paying out as the will stated. Payed school loans for 8 of 11 grandchildren and told 3 unpaid there was no money. Now we have bank staements saying there is money, How do we get the money from the executor???

If this case is docketed as a probate court case, you complain before the court (best with the help of a lawyer). If the case is not in probate, you can attempt to open a new probate case and ask for your own executor/administrator to be appointed. Or, you attempt to negotiate with the executor, first by asking for an accounting and information, and then asking for an explanation of the payouts. All the foregoing assume the complaining party is a party with a legal interest in the outcome.
