Legal Question in Wills and Trusts in Illinois

My father passed away and his exwife is still named on his life ins as beneficary and my brother and half brother are also listed.He was also remarried and the divorce papers say its up to my dad what happens to the money.The life ins company won't tell us anything saying we need to talk to her.She wasted no time in filing a claim but still has to wait for a death certificate.We do not believe she should have any control of the money and wonder doesn't the divorce void her designation.His present wife paid the bills and kept up the payments she also has a daughter not his but should be entitled to a part of it also to pay for the funeral and other expenses. Based on the facts described in your inquiry, the designation of beneficiaries included in your father's life insurance determines which persons are entitled to the proceeds. It is unlikely the provisions in the order of dissolution, his divorce, will control the distribution of the life insurance benefits. Such insurance benefits are distributed apart from his estate property which would be distributed by a last will or trust, or laws of intestacy. It is assumed that the divorce was final before he passed away. However, one must review the divorce order, any will or trust, as well as the life insurance provisions to resolve the issues.
