Legal Question in Wills and Trusts in Illinois
I need help please!
My father passed away and his remains were cremated by my stepmother, against his wishs. I need to know if I have any legal claim to the remains. My intent is to set right the wrongs my stepmother made, and lay my father to rest were he had requested. My father owned a plot next to his mother and father. He had no legal will. My father married my stepmother in 1989, in illinois. Contact me if more information is needed please. Thank You

This is an unfortunate situation. If your father was married to your step mother for 18 years, as his spouse she generally has the right to arrange for his burial.
Without a will and without some kind of written direction from your father, it will be difficult to overcome his spouse's wishes.
