Legal Question in Wills and Trusts in Illinois

can you file a claim in probate court against the estate without having to pay the filing fee if you have little or no income? The case is in Cook or DuPage county, Illinois. From what I have read, there is a $400 filing fee.

There's a difference between filing a claim and filing the case itself. A claim is a written notice that the person who files the claim, the claimant, wishes to provide notice that the decedent's estate should be made available to pay the sums detailed in the claim.

It's another matter to file a case in the probate system and seek to be appointed executor or administrator.

Talk to the clerk of the court where the case is filed or check the websites of the clerk of the court where the case is filed for additional information.
