Legal Question in Wills and Trusts in Illinois

My great aunt took out a cd and made my son the sole beneficiary. He was to receive it when he turned 21 years of age. Because my son was a minor when it was taken out, my uncle was appointed the trustee until my son's 21st birthday. My great aunt passed away in 2004 and my son turned 21 this past June. We found out that my uncle cashed in the cd in 2003, two months before my great aunt went into the nursing home. Her expenses for the nursing home were covered by her insurance, so there would have been no need to liquidate any of her assets. My uncle was the executor of her estate and she did have a will; however, my uncle never probated her will and will not give us copies of it now. What can we do?

What do you mean by sole beneficiary? If he is the only beneficairy the Uncle could not have cashed it in.
