Legal Question in Wills and Trusts in Illinois

Greetings,

My sister's boy friend passed away a month ago, before he died he told her he left a will for her with some of his savings. My sister does not know who is the attorney or how can we find out if he left a will. Thanks for your time.

Attorneys almost always provide clients with a copy, if not originals, of any estate planning documents signed on a given day. Did they live together? Is there a safety deposit box that's jointly held by both of them?

Does your sister have access to her late boyfriend's financial statements? If he hired an attorney to write a Will, he probably paid that attorney for his services. I'd start with his checking account(s), if you have that degree of access.

If he did sign a Will, persons in possession of such Will are legally required to file it with the appropriate county clerk within 30 days of his death. It is possible that this Will has already been filed, or may be filed in the near future. Feel free to call me and I can help you explore this.

Lastly, I recommend that your sister consult with an attorney to determine how to proceed. It will probably be helpful if you had an attorney call the decedent's family on behalf of your sister, just to communicate how serious your sister is.
