Legal Question in Wills and Trusts in Illinois

One of two heirs disposing of property before other heir notified of death - no

My uncle notified me of my grandmother's death three months after she was buried, and said she had left nothing of any value in her home. Her appliances, some furniture, lamps, and phones were removed by my uncle, along with all personal belongings from her bedroom - including the furniture. There was no will left, and uncle says he believed everything was his and took what he wanted. I understand that I am entitled to my deceased father's share of her estate, being the only other heir. Are the removed items considered to be part of her estate and how does a value get placed on them?

Re: One of two heirs disposing of property before other heir notified of death -

You are correct in being entitled to half. You are also correct in the difficulty of establishing the value of what he took. And it could become a question of whether it's worth pursuing -- whether it would cost more than it's worth.

I suggest you consult an attorney with whatever information you have and let them evaluate it.

Sorry I can't be more helpful.
