Legal Question in Wills and Trusts in Illinois

heirs to a will

My parents have both passed away recently. Their wills state that their estate will be split between their 4 children equally. Two of the children are deceased. How is the will devided?

Re: heirs to a will

I'd need to see the language of the will itself. Oftentimes a will gives property to someone either per stirpes or per capita which would allow the deceased's children to inherit. Of course a will can say that now it just goes to the 2 surviving children. Totally depends on how the will was drafted.
