Legal Question in Wills and Trusts in Illinois
hoint tendency
Is it true if something happened to my husband and he was unable to give permission to me to sell home or borrow money on the home even tho it is in joint tendency, I could not do anything unless I was already signed in as his power of attorney ?

Re: hoint tendency
You would have to get his power of attorney to act on his behalf in selling the house. Please call for an appointment.

Re: hoint tendency
That is correct. To convey or mortgage property in joint tenancy requires the signature of both joint tenants (or a qualifed agent under a POA).
