Hello Your HONOR. I wanted to know if I could sue an individual after taking out a loan in my name, using my SOCIAL with her Daughter's info, and not paying it ALL back. There was a verbal agreement made and I have evidence, afidavits, that she done the same to others. I have not paid the loan because I have No income, So does that make it possible for the Law Suit? or Do I have to actually Pay it completely, before anything?

What kind of "verbal agreement" was made, and who were the parties to the agreement? Did you receive any money for letting someone use your name? If you have been a victim of identity theft, I believe a police report is among the first things you need to do (so long as the "verbal agreement" did not include your agreement for the use of your identity). Then, you may wish to file a report with the three credit bureaus (Equifax, Experian and TransUnion) to request a fraud alert on your name and SSN. These are things you can do with no cost to you.
