Legal Question in Wills and Trusts in Illinois
Husband rights - wife owns home - wife dies
My wife owns the home we live in. We've been married for 12 years. I've paid 1/2 taxes and 1/2 home improvement loans for gutters, siding, windows, roof, furnace, decorating, remodeling upkeep etc. In addition, some of the furniture belonged to be from before the marriage. My daughter still lives in the home with us. Do I have any rights to occupy the home in the event of my wife's death? The home is in a revocable trust and her children are the exclusive trustees. I am 54 yrs old.
Thank You

Re: Husband rights - wife owns home - wife dies
The answer to your question all depends on who the trust names as beneficiaries. The trustee only controls the administration or distribution of the trust and has nothing to do with the beneficial interests.
If you haven't reviewed a copy of the trust document, it is very important to do so, and also to have an attorney review it on your behalf to see if you have any rights, and what they are.
Please be sure to consult with an attorney who concentrates in the area of estate planning.
Good luck to you.
