Individual trust

Help. My father had an original living trust that said it was for beneficiary - mother trustee. My father had brain damage she then took him to create a him & her individual trust not including me. He died. She has since told me I will not inherit anything. Is this true. How do I protect what my father wanted..me for beneficiary. I am broke & mother has put her $$ into my name for tax write offs. I am not very bright and do not know anything about this. I cannot find original living trust naming me. Been replaced by newer ''individual trust'' between him & her ONLY. [email protected]

There are many issues here, and the best advice I can give you is to look for an attorney who can advise you based on the all of the available information.

If you don't have money to hire one, contact the DuPage County or Cook County Bar Association to ask for a recommendation to someone who can assist you.

In general, many people set up "revocable" trusts during their lifetimes, which can be changed anytime up to the date of death.

However, if your father did not have the mental capacity to make changes to his trust, you may have a reason to contest it.
