Legal Question in Wills and Trusts in Illinois

invalid will?

My husband and I were divorced 32 years ago. He continued to live in the housr I had signed a quit claim. He always promised he would leave the house to our children. 15 years ago he remarried. He died a couple weeks ago. My son tells me that his brother and sister were left out of the will and the new wife gets half of everything. I worked and paid for the house and it was paid for when she came there. Do my left out children have any recourse? How can we get a copy of the will. The new wife has become quite wealthy as she has gone through this several times. Each time walking away a very rich woman. How do we know the will is valid? These left out children are both very ill and one is homeless.

Re: invalid will?

One issue is how was his promise made? If he just said it to you, and you did not suffer damages by counting on it, little can be done. If however, you can show you relied on his promise, for example by giving up certain items or money in the divorce, expecting him to give your children the house, you may be able to do something. I would need to know more information. Feel free to contact me via email and discuss this with me at no cost.
