Legal Question in Wills and Trusts in Illinois

Irrevocable trust Monies

I'm a beneficiary in an Irrevocable trust, as my siblings. theres also a will for the estate, properties ect. Question. if I passed away, would my siblings & mother get my shares ? or can I set up a will or trust or something for my son and girlfriend to recive my shares ?

Re: Irrevocable trust Monies

The answer to the question depends entirely on the terms of the trust. The extent to which you control the distribution pattern (if at all) after your death depends upon technical language.

If the trust does give you the power to change the distribution pattern, then the trust will also say how to do it.

Do you have a copy of the trust? As always, you should have this looked at by an estate planning specialist. (www.myestateplan.net).

That depends entirely on the explicit terms of the trust. I suggest you obtain a copy of the trust and take to an attorney to review your rights and options.
