Legal Question in Wills and Trusts in Illinois

On June 1, 2017, I received a letter from an attorney informing me that I was a descendant of a named beneficiary (my late mother) in my aunt's living trust. The letter requested that I agree to and sign an appointment form for another family member to be appointed Successor Trustee. I signed and returned the form to her attorney on June 3, 2017. I sent a letter to this attorney on September 17, 2017, identifying myself and stating that I had sent their requested form on June 3, 2017 and that I have not heard back from them. To date (November 15, 2017), I still have not had a response. Is this a normal procedure/amount of time for bringing closure to my aunt's Living Trust?

More facts would be needed relating to your aunt's trust to determine the reasonableness as to length of time for trust settlement. For example, you didn't mention when your aunt had died. There are other factors as well. Appointing a successor trustee is different from issuing final distributions.

It may well be reasonable that your aunt's trust has not been distributed and closed, but the 2-month delay in response to your letter seems excessive. You might want to followup on that.
