What was the law in Illinois in 1956 for a married person that died intestate? a) if they had children, and b) if no children

I don't know, but I believe it used to be 1/3 to the surviving spouse and 2/3 to the children. If there were no children then all to the surviving spouse. I started practicing law in 1974 so I can't guarantee this answer.

As I vaguely recall the law changed soon after I started practicing law to the way it is now: Half to the surviving spouse and half to the children.
