Legal Question in Wills and Trusts in Illinois
Law Suit Settlement and Inheritance
My boyfriend's wife passed away 4 years ago when his daughter was 11 years old. She is now 15.
His wife and he were separated for about a year when she died in child birth. The baby died as well. It was the boyfriends. The boyfriend filed a lawsuit and it was recently settled. The boyfriend received largest sum of the settlement (over 50%) while my boyfriend's daughter only received 10% of the settlement. My boyfriend received nothing although he is caring for her daughter.
Shouldn't this settlement go to the Wife's estate? Shouldn't the daughter received the bulk of the settlement?

Re: Law Suit Settlement and Inheritance
Depends on how the lawsuit and settlement were structured.
The problem is, you have probably already agreed to the settlement by now because the money has been paid out. If you want to talk about remedies that still remain please feel free to give us a call, but you are unfortunately a bit late in the game to change much.
