Legal Question in Wills and Trusts in Illinois

I live in Illinois. Last year both parents died. They had a will and trust of which my sister is the primary executor. The problem is the will did not specify who gets what in regards to the personal belongings (i.e. Furniture, jewelry, car, etc). My dad and I many times throughout years and up until 2 months before his death talked about what I would want in the house. I mentioned a table that's been in family for I believe a century and he said yes. On paper it's valued above $2000. There is allot of animosity between my sister and I and she thinks that because she recently sold parents car that we don't split the money because I'm taking the table. But, there is also jewelry and a coin collection that is worth some money and she told me she won't sell and when I told her then if she won't sell it then she'll need to pay me out for my distribution portion. She went ballistic about it. What recourse do I have and should I seek council with an attorney?

Are your parents' estates subject to probate in the court system? Yes, seeking out the advice of an attorney, bringing in copies of the wills and trusts, would be a good idea.

These are issues that should not have led to added animosity. Yes, consult an attorney, but be careful concerning the approach the attorney might take. Everyone would be best served agreeing on appropriate debits against the ultimate distributions without the stress and expending of time and money.
