Legal Question in Wills and Trusts in Illinois

How long can this go on?

My father-in-law in IL passed away nearly a year ago. The eldest daughter along with an attorney were named co-executors. My sister-in-law has been living in my father-in-law's home, driving his vehicle, using funds from the estate to pay the bills. The elcetric bill alone is over $1k/mo! The house is not listed on the MLS, just a ''For Sale'' sign in the yard. The attorney co-executor has been of little to no help in expediting the process of selling the home. #1-will the other siblings be liable for costs to keep the home running after estate funds have been spent? #2-is there a way to force sis-in-law to move out and place the house with a licensed Real Estate Agent? HELP!

The heirs will not be liable to pay estate expenses. However, the heirs are, in effect, paying estate expenses out of funds they would otherwise take though the probate process. A Personal Representative who is not acting in the best interests of the estate can be removed. I hope you have discussed these concerns with each of the co-executors.

Your attorney should be monitoring what is going on. Court intervention in Ill. may be necessary.
