Legal Question in Wills and Trusts in Illinois

Did I lose out on Inheritance?

My relative died two months ago. I just got a copy of the pourover will.

There was a revocable living trust and deceased relative had always promised I would be compensated at the end for all my help. Yet this is what is stated in the will It says that I have intentionally and with full knowledge omitted to provide for all my heirs who are not specifically mentioned in the terms of this will.

There is also a No Contest Clause, which I can understand being as we dont have any family besides the three left as Personal Reps.

. Does this mean I am totally left out of the trust? All that is mentioned are several people who are called Personal Represetatives. There role is to disperse of property etc.

If I am out of luck can I contest the trust if I have nothing to lose? Trustee is Extremely volatile and says its all being worked out. Havent heard from Trustee in 6 weeks. What are my options?

Re: Did I lose out on Inheritance?

You don't indicate what kind of compensation or reimbursement you were expecting.

For example, if you were a caregiver for the deceased, you may have a claim against the estate. This is not the same thing as being a beneficiary, therefore, it would not be a "contest" against the terms of the will.

I would advise that you talk to an attorney about your role vis a vis the deceased, and provide him/her with any documentation you have to determine whether you have a valid claim.

Good luck to you.
