There are many ways of passing assets. Some go through probate. Some don't. This question cannot be answered unless I know what he owned and how he owned it.

Some sort of probate will likely be necessary if he died without a Will. Even with a Will, assets passing by Will must go through probate. Any attorney will need to know what assets the decedent owned, how they were titled and whether there was a beneficiary designated before knowing whether probate is necessary.
