Legal Question in Wills and Trusts in Illinois

Mentioned in Will?

I have been told by several people that I may have been mentioned in my deceased

boyfriend's will. Since I have no contact with his family, how would I go about finding

out if this is indeed true?

Re: Mentioned in Will?

If he died in Massachusetts, his will should be filed (sometime fairly soon after his death) in the Probate Court of the jurisdiction where he actually died or else where he resided at time of his death. If you tell me what city he last lived in and what hospital, and cover my costs, I can have it checked for you.

If so, you want to be sure that whoever is responsible for his estate, which would be either the named executor or an appointed administrator, knows how to reach you to pay you. That's usually all you need to do to get paid, unless someone refuses.

Re: Mentioned in Will?

Go to the Probate Court in the county in which your boyfriend lived.

Go to the Register of Probate office and ask where the Estate Index is.

Look up your boyfriend's name and copy down the docket number of his estate.

The Registry staff will then retrieve the file for you and you can sit down and read it.

If there is no file it means that your boyfriend's will was not probated.

If you know his attorney's name you can call and ask whether your boyfriend had a will

and whether it has been offered for probate.

Good luck to you.
