mom's last will is not recognized

hello to you all again;

unfortunately our probate has not ended properly.

here is a cliff note of our situation.

dad died 18yrs ago,mom re-married six years ago to a man with no kids, and never married.

my two brothers and i have been in court for over two years defending her will.

our mother owned her house in her name only and had a will.

she passed away in 2003 leaving everything to her three sons.

her 401k she had thruogh work was put into a IRA and leaving her boys as contingent beneficiaries.

a family friend i referred them to invested that under her insructions, which her husband as beneficiary(inherited by law)and if ANYTHING happend to him, her sons will get that money.

one month after moms death, he changed beneficiaries, and gave moms retirement to his sisters.

that is NOT what her intensions were and the financial advisor has told them, and his superiors.

he took every penny out of the joint accounts they had weeks after moms death, in which my brothers name was on those accounts also.

he received 10k, 4 weeks vacation pay,from moms work.

they took out a cash out refinance in 2002 for 70k using moms house as collateral.

we have no idea where that money is.

he passed away in 2004, waked and buried without

After reading the numerous issues and problems you are going through, my best recommendation to you is to sit down with an attorney who is well-versed in probate matters. Only such a person will be able to properly advise you.
