Legal Question in Wills and Trusts in Illinois

My mother passed away there was a will. In it the selling of the home was to be split 3 ways. My sister is saying that since the trailer was sold before my mother passed she does not have to split the money. Is this true?

If the "home" was not in existence on the date of your mother's death, then there is no "home" in the estate to split. On the other hand, you need to find out what your mother's will says about splitting the remaining assets of the estate. If everything is to be split 3 ways, then you would be entitled to one third of the money.

Of course, this answer is solely based on a hypothetical. You should sit down with an attorney who can help you determine what your rights are to your mother's assets.
