Legal Question in Wills and Trusts in Illinois

My mother's husband died on 9/8/2012....they live in Alton Illinois and were married for 10 years he has no children only 6 sisters and 1 living brother both of his parents are died.....the house deed is in his name only and there is no will.....Can she still keep the house?

Did they buy the house during the marriage? She certainly has more rights in the house than any of his siblings but whether there is an absolute right has to be determined on the basis of additional facts. Suggest that you consult a lawyer in your area.

Can she keep the house isn't the same question as can she sell the house, can she use the house as collateral (even for home improvements). etc. This is one of those cases where talking to an attorney is worth the fee. This is not a do it yourself situation. Encourage your mother to consult an attorney specializing in wills and trusts in her area.
