Legal Question in Wills and Trusts in Illinois
Mr. Martin,
Thank you for your response. There is so much to this story. My niece is a lawyer and seems to know all the tricks of the trade or thinks she does. The lawyers we have hired with retainer fees of $10,000+ have not done anything. They have meetings and suggest my son just sign the papers to let my niece take over the estate. He won't do that. His wishes are to respect his aunt's wishes in her trust and carry them out. How do we find a good lawyer? Thank you

The first question that I would have is whether your niece is named as executor or trustee. The next question would be whether she is an estate planning or probate attorney.
Why have your lawyers advised your son to "turn over the estate?" Short of him doing something improper, I can't think of any reason for him to do so if your sister entrusted him with the task of administering her estate.
I notice that you are outside the Chicago area, but if you would like to discuss this matter further, please feel free to contact me.
