Legal Question in Wills and Trusts in Illinois
Mums the word about the Will
I am an heir to an estate. The executor of the Will
and her lawyer refuse to tell the legal heirs what is
being done. We don't know what she is doing
concerning the disbursement of the Will. The deceased
has been dead for over a year. How can we get them to
tell us what is going

As an heir or legatee under a will, you have certain rights by statute. You should have already been given notices and copies of petitions shortly after the estate was opened. The notice helps explain your rights.
In addition, depending on the type of administration involved (supervised or independent), you may have the right to demand an inventory and/or accounting of estate assets.
Generally, it should only take a year or more unless there are estate taxes or other claims or issues with the assets.
You should probably send a letter to the executor and atty to demand an inventory and accounting.
My office has represented beneficiaries of many estates to ensure that their interests are protected and are treated fairly in the estate administration process. Hello. You certainly have a
right to know the events
of this matter. I suggests
that you contact the Office
of the Clerk and find out
when the next court date
is and attend. Also, you
may want to hire an attorney
to review the file, attend
court and advise you as to
what is happening in the case.
