Legal Question in Wills and Trusts in Illinois

My nephew is incarcerated. His father passed recently without leaving a will. His fathers sister is attempting to aquire his estate.My nephew is the only living child and there was no wife.Does my nephew have a legat right to his fatehers estate?

I only mention that my nephew is incarcerated because he is limited in his ability to get the legal advice he needs to ensure his rights as the rightful bebeficiary of his fathers estate.

The Illinois Attorney General and the Department of Corrections will confiscate your nephew's inheritance to pay for the cost of his incarceration. There is a way to avoid State confiscation of your nephew's inheritance but more facts are needed in order to know if your case is eligible for it.
