non-heir trying to steal my mother's estate
my mother died intestate on January 10th, 2002. I am her only child. My mother's first husband was my father. Although she never divorced him, she went on to marry 4-5 other men. I have no idea why she never got a divorce. The man that she was currently ''married'' to, has refused to share anything with me. She owned property, a truck and several bank accounts. This man had nothing prior to meeting my mother. She had a history of attracting, greedy, abusive and manipulative men. I have already been to court and proven that this marriage is bigamous and was declared excutor of her estate. This man is still living in her house, had acces to the accounts and will not comply with the court documents. He calls to harass me and my family. This will have to go to litigation, but my probate attorney refuses to answer my calls or E-mails. Haven't heard from him in over a month. I want to get someone else who will agressively persue this. My father, as the legal surviving spouse in Illinois, is entitled to 1/3 of the estate and cannot legally be left out, regardless of the state of the relationship, without a divorce degree- which of course there isn't one.
