Re: Need to know how to open an Estate case

Being an heir of your father's estate, you would have standing to open a probate estate to have a judge oversee the distribution of the assets.

It sounds like this is something that you might want to do if your brother seems to be wasting the assets of the estate without any accountability.

If you hire an attorney, the attorney can be paid from the estate's assets.

I would suggest calling the local bar association in your county and asking them for a referral to a probate attorney for a conference.

Good luck to you.
