Legal Question in Wills and Trusts in Illinois

Parent's will

My Mother died in March of this year. My brother hanlded her finances and told me there was a will, but now he will not return my phone calls. I am not sure if there is any thing left, but I believe there is. How do I get a copy of the will if he will not give it to me?

It is a crime not to file a will. make sure the will was filed in the county where your mom died. If not contact the local state's attorney

If an Illinois resident dies, any person who has that resident's original last Will is required, by law, to immediately file it with the clerk of the appropriate county. A court can compel the filing of the original Will, if necessary. You can then get a certified copy of the Will from the clerk at minimal cost.
