Legal Question in Wills and Trusts in Illinois

Pension entitlement

My father was a member of the pipe fitters union for 20+ years a vast majority of those years married to my mother. My father passed away four years ago while living in Arizona in close proximity to one of my sisters. Just recently my family discovered that there has been a pension payout going to my sister for the last four years from the union. My question is, due to the fact that my mom was married to my dad for the majority of his tenior with the union is this money not rightfully hers. If so how would you go about recovering it?

Re: Pension entitlement

Your mother's rights to your father's pension depend upon the terms of the pension plan itself. I reccommend your mother contact me or the lawyer of her choice to obtain, review, and interpret the particular pension plan at issue.
