Legal Question in Wills and Trusts in Illinois
pour over will in a revocable living trust
Do I need to file a pour over will that was included in a revocable living trust with the court? I am co-trustee of the trust. It was a trust with my mother, who has passed in May. The attorney who drafted the trust did not mention it. Thank you!

Re: pour over will in a revocable living trust
All wills must be filed with the court within 60 days of death to prevent fraud. You need not open a probate if the value of the property in the pour over will is less than $100,000.00. Then all you need is a small estates affidavit.
