my dad died and had no written will how do I become the power of attorney over his estate

Power of attorney is not the correct term. Someone needs to be appointed as administrator/personal representative for his estate. This involves petitioning the probate court in the county where he lived. Discuss with an attorney in that locale.

A power of attorney dies when the person who has the power to grant power of attorney dies. If the entire estate is worth less than $100,000.00, you will be able to deal with it with a "small estates affidavit." However, if real estate is involved, you will have to file a probate in the county the real estate is located. Please call for further discussion.
