Legal Question in Wills and Trusts in Illinois

Power of Attorney

I just have one question I was hoping to get an answer for. My Brother is terminally ill. He is 34 years old. He want's my to be his power of Attorney. I was just wanting to know if I become his P.A. does it mean I am responsible for his debts or just for his well being.

Thanks, Angie

Re: Power of Attorney

I am sorry to hear about your brother.

Neither power of attorney (discussed below) will make you personally responsible for his debts.

He may want a health care power of attorney so you can make medical decisions for him when he becomes unable to. This will probably mean ultimately deciding whether to continue life-sustaining treatment so I hope you have a chance for a good talk to determine his wishes.

A property power of attorney would enable you to handle his finances when he can't.

Neither of these would make you responsible for his debts.
