Legal Question in Wills and Trusts in Illinois

Probate Means

If a person's father died and left no will, and the property has already gone through probate, what would be the necessary actions needing to be taken in order to receive any inheritance? The deceased's wife has already split assets to other remaining children (hers'), but he hasn't received anything. He is entitled, isn't he? We are just needing to know what steps should be pursued.

Re: Probate Means

If a probate proceeding has already been done, then you should go to the county in which the proceedings have taken place, and obtain a copy of them (they are public records.) That should inform you of the status of the case. There are several ways to probate an intestate (no will) estate. As such, I can't tell you how to proceed without knowing which method they used.
