Legal Question in Wills and Trusts in Illinois

Probate

My parents passed away and all of their assets were in a trust. All assets have been dispursed and there is nothing left. Since then an insurance settlement has been made from the accident that killed my father. Now i guess we have to go to probate for the settlement that was made and was awarded to his siblings. Do we need a lawyer to do that or is it something simple that we can do on our own?

I would suggest that you consult with an attorney. It is possible to open a probate estate by yourself, but there are many procedures that need to be followed. A probate attorney will be able to assist.

I find it interesting that it is your father's estate, but you say that the settlement will be going to his siblings? Were they the only ones who filed the action?

Generally, the assets of the estate would have to be probated. This would depend on a number of factors.
