Probate of property

My brother and his wife died in FL where they were living and there was no will. They have real estate property in IL, their personal property and 2 vehicles. The estate has not been probated, does it need to be? Can I (his sister lives in IL) probate the property or does his son (lives in FL)need to do?

The real estate must be probated in Illinois, along with all other property here. The son is his only heir, but you may be able to file and become the executor of the estate. An executor must live in the state or have an in-state representative. Please call a lawyer in the county in which the property is located.
